Beau Diamond is powered by Shopify, which enables us to provide the Services to you.

The below Terms of Service, together with any policies referenced herein (these “Terms”), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers, limitations of liability, and dispute resolution.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy and Returns & Refunds Policy. If you do not agree, you should not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

You must be at least 18 years old (or the age of majority in your state) to use the Services. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. You may not transfer or assign your account to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to present products accurately. However, colors, carat weights, clarity grades, and dimensions may appear differently depending on your device. Images may be enlarged to show detail. We do not warrant that the quality or appearance of products will meet your expectations. We may change or discontinue products without notice.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We reserve the right to accept, decline, or cancel any order at our discretion, including for suspected fraud, pricing errors, or stock issues. Your order is accepted once we confirm it and process your payment.

Your purchases are subject to our Returns & Refunds Policy. Refunds may be reduced if required certificates, documents, or original packaging are not returned.

Products are for personal use only and not for resale or export.

SECTION 4 – PRICES AND BILLING

All prices are in U.S. dollars and may change without notice. Prices do not include taxes or shipping unless stated otherwise. You agree to provide accurate payment details and authorize us to charge your chosen payment method for the total amount (including shipping, handling, and applicable taxes).

SECTION 5 – SHIPPING AND DELIVERY

Shipping is governed by our Shipping Policy.

  • Orders $500+ require an adult signature on delivery for security and insurance reasons.

  • Title and risk of loss pass to you once the carrier confirms delivery at your address.

  • Delivery estimates are not guaranteed. We are not liable for delays caused by carriers or events outside our control.

  • We do not ship orders of $500+ to P.O. Boxes or APO/FPO addresses.

SECTION 7 – OPTIONAL TOOLS / THIRD-PARTY SERVICES

We may provide you with access to third-party tools, apps, or features (for example, size guides, AR try-on, financing widgets) that we do not control or monitor. You acknowledge that such tools are provided “as is” and “as available,”without warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools.

Any use of optional tools is entirely at your own risk and discretion, and you should ensure you are familiar with and approve the terms on which tools are provided by the relevant third-party providers. Future new features, services, or tools offered through the Services will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites or services. We are not responsible for their content, policies, or actions. Transactions with third parties are at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Beau Diamond is powered by Shopify, which enables us to provide the Services. However, sales are made directly with Beau Diamond. Shopify is not responsible for your purchases. By using the Services, you release Shopify from any liability related to your transactions with Beau Diamond.

SECTION 10 – PRIVACY POLICY

Your use of the Services is subject to our Privacy Policy. Because our store is hosted on Shopify, some of your personal information is also subject to Shopify’s Privacy Policy.

SECTION 11 – FEEDBACK

By submitting reviews, suggestions, or feedback, you grant Beau Diamond a worldwide, royalty-free license to use, reproduce, and display your feedback for business purposes.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

We may correct errors, inaccuracies, or omissions (including after orders are placed) without prior notice.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Beau Diamond is not liable for indirect, incidental, or consequential damages (including lost profits, lost savings, loss of data) arising from your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the product(s) at issue in the 6 months before the claim or $100, whichever is greater.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Beau Diamond and Shopify from any claims, damages, or expenses arising out of your violation of these Terms or your misuse of the Services.

SECTION 18 – DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER

Informal Resolution: You agree to first contact us at infobeaudiamond@gmail.com to try to resolve any dispute informally.

Binding Arbitration: If not resolved within 30 days, disputes will be settled by binding arbitration under the FAA and JAMS Consumer Arbitration Rules, held in Miami-Dade County, Florida (or virtually where permitted).

Class Action Waiver: YOU AND BEAU DIAMOND WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.

Small Claims: Either party may bring an individual claim in small claims court.

SECTION 19 – SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver. These Terms, together with our policies, are the entire agreement between you and us.

SECTION 21 – ASSIGNMENT

You may not transfer your rights without our consent. We may assign or delegate our rights and obligations without notice.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

SECTION 23 – CHANGES TO TERMS

We may update these Terms at any time by posting on our website. Material changes will be notified as required by law. Continued use of the Services means acceptance.
